It's appalling and sad what some individuals will do, apparently, in order to receive a union paycheck.

On July 15, 2003, Union member Alex Tejeda stated "he was in the Office when Ed Venegas told Linda Sexton not to file an appeal [protesting the January 21, 2003 membership vote which purportedly reinstated the 'guilty' verdict against Sexton]," as reported by the Minutes of the General Membership meeting for that date.

Even after that, Tejeda gave his written, sworn statement that he was personally in the room when District 9 representative Ed Venegas "repeatedly directed President Sexton to hold off on filing an appeal to Tony Bixler or anyone else because it was still being investigated if it was legal or not . . . ."

More than an entire year later, on August 17, 2004, Local 9509 appointed Tejeda to a Vice President position within the Local.

Then suddenly, just ten days after his appointment, on August 27, 2004, Alex Tejeda claimed he lied when he swore Ed Venegas ordered Sexton not to appeal. Was this turn-around Tejeda's payment for receiving the Union position?

Sexton pursued her Complaint against President Bahr, the Local and others through the Union's internal procedure. The last step of that process was to appeal to the 66th CWA Annual Convention. However, based in part on Tejeda's turn-around testimony, the CWA Appeals Committee denied Sexton's appeal on the charges against her.

The Committee wrote in its August decision that if Sexton's appeal had been upheld by the delegates, "Sexton would only have the right to appeal the complaint by Frank Sarmiento but not be returned to her position as President of Local 9509" [emphasis added]. Therefore, if the delegates to the Convention had found in favor of Sexton, she would again have been subjected to the CWA internal appeals process and tied up for yet another year. Many CWA delegates realized this and voted against Sexton's appeal, thereby clearing the path for Sexton to file her federal court lawsuit without further delay.
