Linda Sexton is a life-long union supporter. She believes that workers can and should band together to improve their working conditions, and the quality of life for their families.
Sexton has devoted decades of her life to furthering the cause of working people. With this goal in mind, Sexton ran for the office of President of CWA Local 9509. Local members voted overwhelmingly for Sexton's leadership. However, the wrongdoing of a few powerful individuals - at the local, district and national levels - pushed aside the members' democratic vote and removed Sexton from office.
Sexton made every effort to right these wrongs within the privacy of the CWA internal appeals process. But after enduring a sham union trial and the maneuvering of some of her political opponents, Sexton was not able to remedy things privately. Her opponents' refusal to take responsibility for their actions have forced Sexton to pursue the rights of Local 9509 members, including herself, in the district court.
Every union acts through its officers and representatives. The actions of union officers, technically, are the actions of the union. Unfortunately, due to the way labor unions are structured, Sexton had to name as defendants the union entities (Local 9509, District 9 and the CWA national organization), as well as the individuals who participated in the offending acts.
By reading the lawsuit, one can easily see that Sexton's lawsuit is for the purpose of restoring democracy to CWA - not for the purpose of destroying it.
Lawsuit (First Amended Complaint) filed by Linda Sexton in the United States District Court, Southern District, on February 15, 2005.
