Some Local 9509 officers and members oppose Union Democracy and oppose Linda Sexton because she stands for Union Democracy. These members have conducted a vigilante campaign against Sexton, throwing up obstacle after obstacle in an effort to silence her voice for democracy. Some of these obstacles are shown below, including the officers' refusal to pay all of Sexton's wages for her work as Local 9509 President, and a physical assault against Sexton by officer Robin King.

Local 9509 Officers Refused to Pay Sexton's Earned Wages

After President Sexton was removed from office by District 9 representative Jim Weitkamp and Local 9509 Executive Vice President Sandra Martinez on July 14, 2003, Local officers Sandra Martinez, Robin King and John Young illegally refused to pay President Sexton two weeks of the wages she had earned for work performed as Local 9509 President. For months, President Sexton sought her wages. When the Local failed to respond to President Sexton's attempts to receive her pay, Sexton was left with no choice but to file a complaint for unpaid wages with the California Labor Commissioner, which she did in October, 2003.

The three officers of Local 9509 testified at the Labor Commissioner hearing in an attempt to justify the Local's failure to pay Sexton's wages. However, the Labor Commissioner found the officers "not to be credible," and awarded President Sexton her wages, plus an additional $6,932 in fines and penalties for the Local's violation of Labor Code Section 203.

The award of $6,932 was paid from union dues of Local 9509. This fine should never have come from the membership dues. Since it was the actions of three officers who knowingly and wilfully violated the California State Labor Code, this fine should have been paid from their own personal accounts.

Rather then accept responsibility for their actions, these officers placed the blame on Linda Sexton for filing a complaint with the State Labor Commissioner for nonpayment of wages earned. None of these officers publicly acknowledges that Sexton tried for months to get the Local's attention for its failure to pay wages, before finally being forced to seek help from the Labor Commissioner.

Again, these individuals financed their political agenda with our Union dues.
